WWW.ROADAHEAD.COM.AU 66 THE ROAD AHEAD DEC 2009/JAN 2010 MEMBER ESSENTIALS RACQ LEGAL THE NEW ROAD rules legislation states that a person must not carry more people on a bicycle than it is designed to carry. A passenger on a bicycle that is moving or stationary must sit in a seat that is designated for the passenger. You cannot carry a passenger anywhere else on a bicycle (e.g. on the handlebars). If you ride a bicycle and carry a passenger who is not seated on a passenger seat, you risk being fined $40. If you carry a passenger, both you and your passenger must wear approved, securely fitted bicycle helmets. Riders or passengers can be exempt from wearing bicycle helmets for medical reasons, if they are carrying a current doctor's certificate for a stated period. If your passenger fails to wear a helmet and is not exempt for medical reasons, both you and the passenger risk being fined $100. Passengers on three or four-wheeled bicycles who are paying customers of taxi- style businesses are not required to wear a helmet, although for safety, it would be advisable to do so.
